That depends on how far you’ve gone with the case and whether you have correctly followed the guidelines in the property code. If not, we may have to start from the beginning.
No. In accordance to the Texas Property Code and Rules of Civil procedure, anyone can represent a landlord in an eviction case for nonpayment of rent or hold over in Justice of the Peace court. In some circumstances an authorized representative may appear in County Civil Court on behalf of a landlord.

We accept all major credit cards for eviction representation and payment is expected at the time of file acceptance.
Yes. The terms of the lease agreement still applies and you can file the eviction.
Yes. The courts will view your case as having a verbal lease agreement and provide the landlord the same legal protection as if there was written lease agreement.
It’s best to send the following documents:
- Lease Agreement
- 1st page of the Lease Application
- Photo ID’s of the tenants
- Rent Roll (an accounting of when rent was due and when it was paid)
If you have determined your tenant has moved out and has abandoned the home, you do not need to file an eviction. You may take immediate possession of the home.
You may start the process when the tenant is one day late or within the terms of your lease agreement.

You will receive a copy of the judgement as soon as the court records it and mails us a copy. This may take about seven days after the hearing.
You cannot collect for damages and late fees in an eviction case. The eviction case will only award back rent. You must file another case in Small Claims Court for late fees and damages.
Most judges will DISMISS an eviction case for nonpayment of rent if a landlord accepts rent from a tenant after the eviction was filed.

Communication is very important and we need to discuss the process, options, and outcomes with all parties. We make every attempt to communicate with the tenant.
The process takes about 30 days but depends on how busy the courts are and could take up to 45 days if the tenant files an appeal.
